NATO Prepared Tallinn Manual -International Law Applicable to Cyber Warfare

NATO finally published the final version of a document expected to shape cyber warfare policies among Western nations was published last week, clarifying when and how countries can legally conduct online aggression against one another. The International law of Cyber Warfare have been  published by the Cooperative Cyber Defence Centre of Excellence (CCDCOE) set up in Estonia, in 2008, the Tallinn Manual on the International Law Applicable to Cyber Warfare. Spanning 215 pages, the Tallinn Manual makes it clear that a full-scale war can be triggered by network-borne attacks on computer systems and that civilian activists that participate in those are considered legitimate targets. However, the manual specifically rules out state-sponsored attacks on critical civilian infrastructure. Nuclear power plants, hospitals, dams and similar are all out of bounds for cyber war, the manual states.

The Tallinn Manual:-
The Tallinn Manual on the International Law Applicable to Cyber Warfare, written at the invitation of the Centre by an independent ‘International Group of Experts’, is the result of a three-year effort to examine how extant international law norms apply to this ‘new’ form of warfare. The Tallinn Manual pays particular attention to the jus ad bellum, the international law governing the resort to force by States as an instrument of their national policy, and the jus in bello, the international law regulating the conduct of armed conflict (also labelled the law of war, the law of armed conflict, or international humanitarian law).  Related bodies of international law, such as the law of State responsibility and the law of the sea, are dealt within the context of these topics.
The Tallinn Manual is not an official document, but instead an expression of opinions of a group of independent experts acting solely in their personal capacity.  It does not represent the views of the Centre, our Sponsoring Nations, or NATO.  It is also not meant to reflect NATO doctrine.  Nor does it reflect the position of any organization or State represented by observers.

Suspected Russian Hacker Behind Cyber Attack on Georgia Caught on His Webcam 

It said that there may be hundred ways to commit crimes but there are chances of one hundred and one times to get busted. Exactly the same things happened for a Russian hacker who was behind the cyber attack against the country of Georgia. Since 2011 Georgia is blaming that few Russian hackers are disturbing their cyber space while attacking its computer networks, injecting malicious code into websites, and planting spyware to steal classified information. After discovering that a cyber-spy was infecting government computers with malware designed to mine important documents, government officials decided to fight fire with fire. They intentionally allowed the malicious software to infect one particular computer, and baited it with a ZIP file called “Georgian-Nato Agreement” — exactly the sort of thing they knew the intruder would be looking for. Instead of important documents, however, the bait file was loaded with the hacker’s own malware. Once the hacker downloaded and opened the file, the software went to work stealing his documents and, best of all, hijacking his webcam to capture clear video of his face. According to the CERT-Georgia report, an analysis of the attack's command-and-control center revealed that at least 390 computers were infected in the attack. 70% of compromised PCs were based in Georgia, with other victims found in the USA, Canada, Ukraine, France, China, Germany and Russia. Computers hit in Georgia were predominantly based in government agencies, banks and critical infrastructure the report claims. 
In a 27 page report, the Georgian government explains in details that, how in early 2011 Georgian news websites were hacked in order to exploit vulnerabilities, and spread malware that hijacked infected computers and searched for sensitive documents. 
According to report by Naked SecurityGeorgian officials lay a trap. Georgia's CERT deliberately infected one of its own PCs with the malware, and planted a ZIP file named "Georgian-Nato Agreement" on its drive, hoping it would prove irresistible for the hacker. Sure enough the hacker stole the archive file and ran malware that Georgia CERT had planted inside, meaning that now investigators had control over the hacker's own computer. This made it relative child's play to capture images of the suspect at work in front of his PC. The CERT researchers claim that they also found a Russian email conversation on the suspect's computer in which he gives instruction on how to use his malware and infect targets. Furthermore, the suspected hacker's city, ISP, email address and other information were also acquired. Curiously, a domain used by the attackers was registered to an address in Moscow belonging to the Russian Ministry of Internal Affairs, department of logistics - which just happens to be based close to the Russian Secret Service (FSB). Furthermore, according to CERT-Georgia, websites used to control the infected Georgian computers have links with RBN, the notorious Russian Business Network.

Anonymous Releases More than 1 GB Restricted Document of NATO


The hacking collective Anonymous released a document on Thursday marked "restricted" from the North Atlantic Treaty Organization (NATO). The 36-page document, which is dated Aug. 27, 2007, appears to be budget and equipment outlays for what was termed a new "HQ ISAF JOINT CIS CONTROL CENTRE." NATO's press office could not be immediately reached.
Anonymous claimed on its "AnonymousIRC" Twitter handle that it has 1GB of material from NATO but said that most would not be published because it would be "irresponsible."
In another Tweet, Anonymous said that the data was harvested via "simple injection," which usually refers to inputting malformed data in Web-based forms and seeing if the back-end database responds with information.


The group prefaced its release of the NATO document with an earlier comment on Twitter about its alleged trove of e-mail from the British tabloid The Sun, part of Rupert Murdoch's News Corp. media group that is under investigation for voicemail interception and paying police officers for information.

"We think actually we may not release emails from The Sun, simply because it may compromise the court case," according to a Twitter post from Anonymous.
LulzSec, known as LulzSecurity, claimed credit on Twitter on Monday for that attack, but the two groups are somewhat aligned. Although LulzSec said it was going dormant after a string of highly successful attacks against the U.S. Central Intelligence Agency, PBS.org and Fox.com, among others, it appears to be back in action. LulzSec hit The Sun's website on Monday, posting a fake news story that Murdoch had died.

The two groups also posted a statement on Pastebin directed at Steven Chabinsky, a deputy assistant director in the U.S Federal Bureau of Investigation's cyberdivision.
"Your threats to arrest us are meaningless to us as you cannot arrest an idea," the statement said. "Any attempt to do so will make your citizens more angry until they will roar in one gigantic choir."

3 Anonymous suspects get busted in Spain


Police in Spain have arrested three cyber criminals who are suspected to be members of the online ‘hactivist’ group, Anonymous. The group has been in the news recently with their attack on the Sony PlayStation Network, the Indian army website as well as the Indian government website - NIC.According to the Spanish police Twitter feed, the hackers were arrested in Spanish cities of Barcelona, Alicante and Almeria and a server hosted in Gijon was seized, as well. They also claim that they have dismantled the Anonymous hacker group in Spain who were responsible for attacking the PlayStation Store. The police said that these individuals have the capacity to make decisions and direct attacks. They also claim that the group has the ability to coordinate DDoS attacks to collapse Web sites around the world and are considered a threat by NATO.
According to a report, these arrests were made after investigation which began in October 2010. The Spanish police say that the arrests were made after going through millions of lines of chat logs to discover who was behind the group’s activity. The report goes on to say that some of the attacks made by the group’s members used a web based tool called Loic to fill the targeted sites with the required data.

Responding to a recent report from the North Atlantic Treaty Organization condemning  Anonymous, the online "hacktivist" group has issued a public response warning the global organization not to challenge it. Claiming that the NATO report singled it out as a threat to "government and the people," Anonymous defended some of its recent actions in the name of freedom and dissent. In its message (Google cached version), it also asserted that NATO fears the group not because it's a "threat to society," but because it's a "threat to the established hierarchy."
Issued last month by Lord Joplin, general rapporteur of NATO, the report warned member nations about the rising threat of "hacktivism," or carrying out cyberattacks for political purposes. Singling out Anonymous, NATO described several of the group's most recent actions, including the distributed denial-of-service attacksagainst MasterCard, Visa, PayPal, Amazon, and others that had cut off services for WikiLeaks.
Noting that Anonymous has become more sophisticated, the NATO report cautioned that it could hack into sensitive government, military, and corporate information and described a strong response against the group. "Today, the ad hoc international group of hackers and activists is said to have thousands of operatives and has no set rules or membership," said the report. "It remains to be seen how much time Anonymous has for pursuing such paths. The longer these attacks persist the more likely countermeasures will be developed, implemented, the groups will be infiltrated and perpetrators persecuted." In its response, Anonymous tried to soften its stance in parts by saying that it doesn't want to threaten anyone's way of life or terrorize any nation. But it made clear its reaction to NATO's report. "Finally, do not make the mistake of challenging Anonymous," warned Anonymous in its message. "Do not make the mistake of believing you can behead a headless snake. If you slice off one head of Hydra, ten more heads will grow in its place. If you cut down one Anon, ten more will join us purely out of anger at your trampling of dissent." NATO's report also provided a larger look into the growing danger of cyberattacks and how governments should respond to them. In the report, Joplin asked the question of how NATO should react if one of its member nations was the victim of a cyberattack. "Can one invoke Article 5 of the Washington Treaty after a cyber attack?" asked the report. "And what response mechanisms should the Alliance employ against the attacker? Should the retaliation be limited to cyber means only, or should conventional military strikes also be considered? Both the U.S. and the U.K. have recently made their own positions clear--that they consider cyberwarfare another form of warfare, and one potentially subject to a response using conventional military weapons.

NATO Said:- Anonymous will be "infiltrated" and "persecuted"


The North Atlantic Treaty Organization contains the combined military might of 28 member countries, including Germany, the United Kingdom, and France. All three of those nations, and the United States, possess huge armies, nuclear weapons, and are committed to Article Five of NATO's charter:
"The Parties agree that an armed attack against one or more of them in Europe or North America shall be considered an attack against them all and consequently they agree that, if such an armed attack occurs, each of them, in exercise of the right of individual or collective self-defence recognised by Article 51 of the Charter of the United Nations, will assist the Party or Parties so attacked."
Yet reading NATO's new draft general report on cyber security, one gets the impression that what the alliance worries about most these days is not an "armed attack," but a cyberattack on its network servers, or the infrastructure of any of its member countries.
"In this Information Age, the North Atlantic Alliance faces a dilemma of how to maintain cohesion in the environment where sharing information with Allies increases information security risks," NATO's Information and National Security survey observes, "but where withholding it undermines the relevance and capabilities of the Alliance."
And WikLeaks and Anonymous get top billing as visible threats to NATO's efforts to control its information perimeters.
"The time it takes to cross the Atlantic has shrunk to 30 milliseconds, compared with 30 minutes for ICBMs and several months going by boat," the report warns. "Meanwhile, a whole new family of actors are emerging on the international stage, such as virtual 'hactivist' groups. These could potentially lead to a new class of international conflicts between these groups and nation states, or even to conflicts between exclusively virtual entities."

The irony of 9/11:-

Authored by Lord Michael Jopling, Rapporteur for NATO, the study begins with an irony. Following the attacks of September 11, 2001 on New York City and Washington, DC, the United States government concluded that one of the reasons that the plot succeeded was because information about its perpetrators wasn't widely shared among US intelligence agencies, especially the Department of Defense, CIA, State Department, and Federal Bureau of Investigation.
And so the US opened up its data sharing practices. This made matter worse, Jopling appears to suggest. It "resulted in an exponential number of people obtaining access to classified information." Over 850,000 functionaries now enjoy some kind of "top-secret" security status, he claims. Many have access to the DoD's Secret Internet Protocol Router Network (SIPRNet), dispenser of embassy cables.
The study cites critics of SIPRNet who say that it lacks the ability to detect unauthorized access. "Thus, those in charge of the network design relied on those who had access to this sensitive data to protect it from abuse. These users were never scrutinized by any state agency responsible for the data-sharing system."
Jopling doesn't explicitly blame this openness policy for WikiLeaks phenomenon, but his narrative leads right into Private Bradley Manning, accused of providing documents for the outfit, prompting the group's famous publication of a continuous stream of State Department cables.
Not surprisingly, he thinks that this is bad:
The Rapporteur believes that even if one is in favour of transparency, military and intelligence operations simply cannot be planned and consulted with the public. Transparency cannot exist without control. The government, and especially its security agencies, must have the right to limit access to information in order to govern and to protect. This is based on the premise that states and corporations have the right to privacy as much as individuals do and that secrecy is required for efficient management of the state institutions and organizations.

A big chunk of the assessment is devoted to the activities of Anonymous, most notably its denial-of-service attacks against PayPal, MasterCard, Visa, and Amazon.com for shutting down financial and server space services to WikiLeaks. Next comes the Anonymous assault on HBGary Federal, which had been planning some methods to take down WikiLeaks and expose Anonymous. It didn't turn out that way, of course. Instead, Anonymous penetrated the security company, erasing data, publishing e-mails, and wrecking its website.
The author seems confident, however, that the notorious group's days are numbered. "It remains to be seen how much time Anonymous has for pursuing such paths," Jopling writes. "The longer these attacks persist the more likely countermeasures will be developed, implemented, the groups will be infiltrated and perpetrators persecuted."
But the larger question hovering over this document is what NATO should do if one of its over two-dozen member nations is cyberattacked. The US has lately been pondering this dilemma as well.
"Certain hostile acts conducted through cyberspace could compel actions under the commitments we have with our military treaty partners," says a White House strategy report published in mid-May. "When warranted, the United States will respond to hostile acts in cyberspace as we would any other threat to our country."
This NATO draft seems to want to go in a similar direction—especially if something on the scale of a Stuxnet malware attack is deployed against a member nation. Designed to penetrate software for industrial equipment, researchers believe that it was originally intended for Iran's nuclear program.
"Some argue that Article 5 should not be applied with respect to cyberattacks because their effect so far has been limited to creating inconvenience rather than causing the loss of human lives and because it is hard to determine the attacker," Jopling notes. "However, The Rapporteur believes that the application of Article 5 should not be ruled out, given that new developments in cyber weapons such as Stuxnet might eventually cause damage comparable to that of a conventional military attack."
